INFORMATION / CLARIFICATION TEXT REGARDING THE PROCESSING OF PERSONAL DATA

This text has been prepared to inform you about which personal data is processed by the data controller; for what purpose, how and why it is processed, with whom it is shared and how long it is stored. This clarification text has been prepared within the scope of Article 10 of the Personal Data Protection Law No. 6698. As DR. ERHAN BAYRAM CLINIC, we prioritize patient privacy in our clinic activities. Personal data of our patients, patient relatives, employees and other persons related to the clinic who benefit from the health and consultancy services we provide are processed and stored in accordance with the relevant legislation, especially the T.C. Constitution, international conventions and the KVKK No. 6698.

Collection and Processing of Personal Data

Various information is collected from our patients, their legal representatives, our employees and third parties within the scope of our services. The collected information is obtained in accordance with the data processing principles and conditions in the KVKK No. 6698. Among special categories of personal data; health data may be processed by persons or authorized institutions/organizations under the obligation of confidentiality for the protection of public health, preventive medicine, medical diagnosis, treatment and care services, planning and management of health services and financing, without the explicit consent of the data subject. Your personal data shared at the polyclinic is recorded, stored, changed and reorganized by automatic or non-automatic methods, obtained in verbal, written, visual or electronic environment through all channels including website, survey, social media applications.

Collected Personal Data

Examples of collected data groups are given below. Content may vary depending on the service/relationship scope. • Identity information: Name, surname, ID passport/driver's license copy, TR ID number, place/date of birth, marital status, gender, insurance/protocol number, etc. • Contact information: Address, phone, relative's contact number, e-mail, helpline call records, etc. • Accounting information: Bank account/IBAN, credit card information, billing information, etc. • Social security / insurance data: Private health insurance and SSI related data. • Security records: Camera recordings for clinic security, EEG recordings, etc. • Health data: Laboratory/test results, examination data, prescription information, all health data obtained during medical diagnosis, treatment and care (including special category data). • Biometric and visual data: Photos related to service, image and audio recordings. • Remote meeting data: Identity, contact, health, sexual life and genetic data obtained during video consultancy, audio-visual data and client file records.

Purposes of Collecting Personal Data

Your shared personal data may be processed for the following purposes: • Fulfilling legal obligations (Regulations 3359, 663 and relevant legislation). • Fulfilling contractual responsibilities and providing services. • Planning, financing and management activities related to health services. • Sharing information with the Ministry of Health and other public institutions/organizations when legally required. • Protection of public health, preventive medicine, diagnosis, treatment and care services. • Providing information to judicial authorities in legal processes. • Providing consultation/counseling service and taking data security measures. • Appointment notification, abuse tracking, patient satisfaction measurement, training and quality processes. • Drug/medical device supply, personnel management and human resources operations. • Marketing, media and communication activities (with consent). Your personal data may be stored in both physical and digital archives; may be transferred to contracted institutions when necessary.

Explicit Consent in Processing Personal Data

Pursuant to KVKK articles 5 and 6, personal data cannot be processed without the explicit consent of the data subject. However, there are exceptional cases specified in the law (e.g. being explicitly stipulated in laws, vital danger, being related to the establishment/performance of a contract, fulfilling the legal obligation of the data controller, etc.). Special categories of personal data (race, ethnic origin, political opinion, philosophical belief, religion, appearance, union membership, health, sexual life, criminal conviction, biometric/genetic data, etc.) cannot be processed without the explicit consent of the data subject as a general rule. However, data related to health and sexual life may be processed without explicit consent in certain cases regulated by law (public health, preventive medicine, treatment, financing planning, etc.). In short; data will be processed in accordance with law and good faith rules, connected to the purpose, limited and proportionate, accurate and up-to-date.

Processing and Storage Period of Personal Data

Your personal data will be processed in accordance with the periods determined by the KVKK and relevant legislation (statute of limitations, etc.) and for as long as the purposes specified in this text exist. The storage period for health data is 20 years as a rule.

Persons and Organizations to Whom Personal Data May Be Transferred

Your personal data may be transferred to institutions/organizations permitted by the relevant legislation; for example: • Social Security Institution, Ministry of Health and affiliated sub-units • Security forces under the Ministry of Interior, prosecutors, courts and other official authorities • Private insurance companies, laboratories, imaging centers and business partners • Lawyers, consultants, auditors in case of legal disputes • Domestic organizations and third parties from whom we receive contractual services Example collaborating institutions: Biolab Medical Microbiology Laboratories, Talatpaşa Medical Laboratory, Barış Medical Imaging Center.

Personal Data of Children

Personal data of individuals under 18 years of age; in cases requiring explicit consent, are processed with the consent of the minor's parent or guardian.

Rights of the Personal Data Owner

Pursuant to Article 11 of KVKK, the personal data owner has the following rights: • Learning whether personal data is processed • Requesting information if processed • Learning the purpose of processing and whether it is used appropriately • Knowing the third parties to whom data is transferred domestically/abroad • Requesting correction if data is incomplete/incorrectly processed • Requesting deletion or destruction of personal data under Article 7 of KVKK (evaluated within the framework of legislation for health data) • Requesting notification of the operation to third parties in case of correction/deletion/destruction of data • Objecting to results against you by automated systems analysis • Claiming damages if harmed by unlawful processing • Withdrawing your consent for data processing at any time You can make your right requests via the e-mail address registered in your previous notification, with secure electronic signature or mobile signature to our KEP address, or by wet-signed petition via mail/address. Your request will be concluded free of charge within the shortest time and at the latest within 30 (thirty) days, depending on its nature.
